Medical Malpractice Expert Witness Services for Attorneys

Med Legal Pro locates, screens and prepares medical malpractice expert witnesses for attorneys nationwide, on both the plaintiff and the defense side. We match the defendant’s specialty, separate the standard of care opinion from the causation opinion, and run a conflict check before any name is released, so the expert you disclose survives a qualification challenge from opposing counsel.

Which expert does a medical malpractice case actually need

Most malpractice experts are attacked on fit, not on substance. A general internist offered against a cardiothoracic surgeon, or a physician offered on nursing practice, hands opposing counsel an easy motion. The table below is how we map the case theory to the discipline.

Case theoryPrimary expert discipline
Surgical complications, retained objects, wrong site proceduresBoard certified surgeon in the defendant’s specialty
Missed or delayed diagnosis of cancerSame specialty as the defendant on standard of care, oncologist on causation and prognosis
Emergency department failure to diagnose stroke, heart attack or sepsisEmergency medicine physician, plus neurology, cardiology or infectious disease on causation
Birth injury, shoulder dystocia, hypoxic brain injuryObstetrician or maternal fetal medicine, labor and delivery nurse, neonatology or pediatric neurology
Anesthesia eventsAnesthesiologist or nurse anesthetist matched to the provider who was at the head of the bed
Medication and prescribing errorsClinical pharmacist or pharmacologist, plus the prescriber’s specialty
Hospital nursing failures, monitoring and escalationRegistered nurse with experience on the same type of unit
Radiology and pathology misreadsRadiologist or pathologist, ideally with the same subspecialty training
Cause of death disputesForensic pathologist
Damages and future cost of careCertified life care planner

Qualification and merit rules the expert has to satisfy

Medical malpractice has more front loaded expert requirements than any other civil case type, and they vary by state. Pennsylvania requires a certificate of merit within 60 days of filing the complaint under Pa.R.C.P. 1042.3, and the MCARE Act at 40 P.S. 1303.512 sets same or similar specialty and active practice requirements for the standard of care expert. Texas requires a served expert report within 120 days of each defendant’s original answer under Tex. Civ. Prac. and Rem. Code 74.351. New Jersey requires an affidavit of merit under N.J.S.A. 2A:53A-27. In federal court, Federal Rule of Evidence 702 was amended in December 2023 to make clear that the proponent must show admissibility by a preponderance of the evidence.

A credible expert states opinions to a reasonable degree of medical or nursing certainty, ties each criticism to a specific entry in the record, and explains causation in plain terms. That is what we train for, and what we check before a report goes out.

Records to pull before the expert starts

  • Complete certified chart for every relevant admission and office visit, not a printout summary
  • Physician orders, progress notes, nursing notes and flow sheets
  • Medication administration records and pharmacy dispensing records
  • Actual imaging studies, not just the radiology reports
  • Pathology reports, and the slides and blocks if a misread is alleged
  • Anesthesia record, operative report and intraoperative nursing record
  • Fetal monitoring strips for any labor and delivery claim
  • The electronic health record audit trail for the critical time window
  • Records from before and after the event, to separate the injury from the baseline
  • Policies and protocols in effect on the dates at issue

If the production is disorganized or incomplete, an organized chronology or a medical case summary first is almost always cheaper than paying a specialist to sort paper.

How the Med Legal Pro process works

  1. Case intake. You send the theory, the jurisdiction, the key dates and the parties. No records are needed to start a search.
  2. Conflict check. We screen candidate experts against the parties, the defendant providers, their hospitals and practice groups, and prior engagements before any name reaches you.
  3. Match and confirm. You receive a short list with credentials, testimony history and rate, plus confirmed availability.
  4. Record work. Optional chronology, case summary or record review so the expert opens an organized file.
  5. Quality control. Written work product is reviewed against the standards we train our experts on before it goes out.

Tracy L. Liberatore, Esq., PA-Emeritus, founded Med Legal Pro in 2016 and personally runs the matching, screening, training and quality control side. She does not take cases and does not serve as an expert witness. The opinions come from the experts on the roster.

Frequently asked questions

What kind of expert do I need for a medical malpractice case?

Usually two opinions: standard of care and causation. The standard of care witness should practice in the same or a similar specialty as the defendant, and many states make that a statutory requirement. Causation is often a different discipline, for example an oncologist on whether a delayed cancer diagnosis changed the outcome, or a pediatric neurologist in a birth injury case.

Can you find an expert in time for a certificate or affidavit of merit?

Tell us the deadline at intake. Merit filings run on short clocks in many states, such as 60 days after the complaint under Pennsylvania Rule 1042.3, so we prioritize those searches and confirm the expert’s willingness to support the filing before the name is released.

Do you work with defense counsel?

Yes. Med Legal Pro serves any attorney handling medical malpractice, personal injury, nursing home and long term care, or wrongful death matters, on the plaintiff side, the defense side or in criminal matters. Screening and conflict checking are identical regardless of who retains us.

Can you review the records before we retain an expert?

Yes. A medical case summary or a court ready chronology often tells you whether the case is worth an expert retainer. It also gives the expert an organized record instead of a raw production, which shortens the review and lowers the bill.

Will the expert testify at deposition and trial?

The roster is built around experts who are prepared to give deposition and trial testimony, and Med Legal Pro trains and quality checks their written work before it leaves the file. Availability for a specific trial date is confirmed at engagement.

What does a medical malpractice expert witness cost?

Rates are set by the individual expert and vary with specialty, record volume and whether testimony is required. Surgical subspecialists generally cost more than generalists. We quote the specific expert before you commit, so there is no open ended engagement.
