Which expert does a wrongful death case actually need

A wrongful death claim stands on two medical questions: what killed the person, and whether the defendant’s conduct was a substantial factor in that death. Those are often two different experts. The table below is how we map the case to the discipline.

Medical questionPrimary expert discipline
Cause and mechanism of deathForensic pathologist
Death after hospital or physician carePhysician or nurse in the defendant’s specialty, plus a forensic pathologist on cause
Death in a nursing home or assisted living facilityNursing home administrator or director of nursing, geriatrics on causation
Overdose, medication or toxic exposure deathsToxicologist or clinical pharmacologist
Delay in emergency care or transportEmergency medicine physician or emergency medical transport expert
Conscious pain and suffering before deathForensic pathologist or critical care physician
Death of a childPediatric specialist matched to the setting, such as pediatric emergency medicine

Lost earnings and household services are usually proven by a forensic economist. We focus on the medical side and coordinate with the economist you retain.

The legal framework the expert has to work inside

Most states split a death case into two claims. The wrongful death action compensates the family for its own losses, and the survival action carries forward the claims the person would have had, including conscious pain and suffering. In Pennsylvania these sit at 42 Pa.C.S. 8301 and 8302, and the two year limitations period for the wrongful death claim under 42 Pa.C.S. 5524(2) generally runs from the date of death. The medical expert’s job is different for each claim, which is why the opinion has to address both causation of death and what the person experienced before it.

The death certificate is a starting point, not the answer. Certifiers often list the terminal event rather than the underlying cause, and a credible expert explains where the certificate is right, where it is incomplete, and why.

Records to pull before the expert starts

  • Autopsy report, photographs, histology slides and toxicology results
  • Medical examiner or coroner investigation file
  • Death certificate, including any amended versions
  • EMS run sheet and police or incident reports
  • Complete records of the final admission or facility stay
  • Medication administration and pharmacy records
  • Prior medical records establishing the person’s baseline health
  • Any imaging from the final illness or injury

If the production is disorganized or incomplete, an organized chronology or a medical case summary first is almost always cheaper than paying a specialist to sort paper.

How the Med Legal Pro process works

  1. Case intake. You send the theory, the jurisdiction, the key dates and the parties. No records are needed to start a search.
  2. Conflict check. We screen candidate experts against the parties, the decedent’s providers and facilities and prior engagements before any name reaches you.
  3. Match and confirm. You receive a short list with credentials, testimony history and rate, plus confirmed availability.
  4. Record work. Optional chronology, case summary or record review so the expert opens an organized file.
  5. Quality control. Written work product is reviewed against the standards we train our experts on before it goes out.

Tracy L. Liberatore, Esq., PA-Emeritus, founded Med Legal Pro in 2016 and personally runs the matching, screening, training and quality control side. She does not take cases and does not serve as an expert witness. The opinions come from the experts on the roster.

Frequently asked questions

What kind of expert do I need for a wrongful death case?

Almost every wrongful death case needs a cause of death opinion, usually from a forensic pathologist. On top of that you need the expert who matches the underlying negligence: a physician or nurse in the defendant’s specialty for a medical death, a nursing home administrator for a facility death, or a toxicologist for an overdose.

What if there was no autopsy?

A forensic pathologist can still give a cause of death opinion from the clinical records, the death certificate, imaging and the circumstances. The opinion is narrower and opposing counsel will test it harder, so the expert needs a complete record. If the body has not yet been released, ask about a private autopsy immediately.

Can an expert testify about conscious pain and suffering?

Yes. Survival damages often depend on whether the person was aware between the injury and death, and for how long. A forensic pathologist or a critical care physician reads the EMS, hospital and autopsy findings to answer that question.

Do you work with defense counsel?

Yes. Med Legal Pro serves any attorney handling medical malpractice, personal injury, nursing home and long term care, or wrongful death matters, on the plaintiff side, the defense side or in criminal matters. Screening and conflict checking are identical regardless of who retains us.

Can you review the records before we retain an expert?

Yes. A medical case summary or a court ready chronology often tells you whether the case is worth an expert retainer. It also gives the expert an organized record instead of a raw production, which shortens the review and lowers the bill.

What does a wrongful death expert witness cost?

Rates are set by the individual expert and vary with specialty, record volume and whether testimony is required. We quote the specific expert before you commit, so there is no open ended engagement.
