Personal Injury Medical Expert Witness Services for Attorneys
Med Legal Pro locates, screens and prepares medical expert witnesses for personal injury attorneys nationwide, on both the plaintiff and the defense side. Motor vehicle, premises, workplace and product cases all turn on the same medical questions: what the injury is, whether the event caused it, and what it will cost. We match each question to the right specialist and run a conflict check before any name is released.

Which expert does a personal injury case actually need
Personal injury cases rarely need one generalist. They need the specialist who treats the injured body system for causation, and a different expert for future care and cost. The table below is how we map the disputed issue to the discipline.
| Disputed issue | Primary expert discipline |
|---|---|
| Spine injury, disc herniation, surgery recommendation | Orthopedic spine surgeon or neurosurgeon, plus radiology on imaging comparison |
| Fractures and joint injuries | Orthopedic surgeon |
| Traumatic brain injury and concussion | Neurologist, plus neuropsychologist for cognitive testing |
| Aggravation of a pre-existing condition | Specialist in the affected system, with prior records and prior imaging |
| Chronic pain and complex regional pain syndrome | Pain management or physical medicine and rehabilitation |
| Hearing loss and tinnitus | Otologist or otolaryngologist |
| Workplace and toxic exposure injuries | Occupational medicine physician |
| Future medical care and its cost | Certified life care planner |
| Reasonableness of medical bills | Medical billing and coding reviewer |
Causation is where these cases are won or lost
Defense counsel will point to degeneration, gaps in treatment and prior complaints. Plaintiff counsel needs an expert who has read the prior records and can explain, in terms a jury follows, why the event was a substantial factor in the injury. Either way, the opinion has to clear the admissibility standard in your forum. Federal courts and most states apply Daubert and Federal Rule of Evidence 702, which was amended in December 2023 to tighten the court’s gatekeeping role. Pennsylvania, New York and several other states still apply the Frye general acceptance test.
Records to pull before the expert starts
- EMS run sheet and emergency department records from the date of the event
- All treating provider records, including physical therapy and chiropractic
- Actual imaging studies, both after the event and every prior study you can find
- Prior medical records for the same body part, typically five to ten years back
- Pharmacy records showing prescriptions before and after the event
- Itemized bills, not balance summaries
- Any independent medical examination report and the examiner’s notes
- Photographs of visible injuries with dates
If the production is disorganized or incomplete, an organized chronology or a medical case summary first is almost always cheaper than paying a specialist to sort paper.
How the Med Legal Pro process works
- Case intake. You send the theory, the jurisdiction, the key dates and the parties. No records are needed to start a search.
- Conflict check. We screen candidate experts against the parties, the insurers, the treating providers and prior engagements before any name reaches you.
- Match and confirm. You receive a short list with credentials, testimony history and rate, plus confirmed availability.
- Record work. Optional chronology, case summary or record review so the expert opens an organized file.
- Quality control. Written work product is reviewed against the standards we train our experts on before it goes out.
Tracy L. Liberatore, Esq., PA-Emeritus, founded Med Legal Pro in 2016 and personally runs the matching, screening, training and quality control side. She does not take cases and does not serve as an expert witness. The opinions come from the experts on the roster.
Frequently asked questions
What kind of medical expert do I need for a personal injury case?
It depends on what is actually disputed. If the fight is over whether the crash caused the injury or only aggravated an old condition, you need a specialist in the injured body system, often with a radiologist comparing pre and post accident imaging. If the fight is over the size of the claim, a life care planner and a medical billing reviewer usually matter more.
Can the expert address a pre-existing condition?
Yes, and it is one of the most common reasons we are called. The expert compares the baseline records with the post accident course and explains which symptoms, treatment and future care are attributable to the event. That analysis is only as good as the prior records, so pull them early.
Do you work with defense counsel?
Yes. Med Legal Pro serves any attorney handling medical malpractice, personal injury, nursing home and long term care, or wrongful death matters, on the plaintiff side, the defense side or in criminal matters. Screening and conflict checking are identical regardless of who retains us.
Can you review the records before we retain an expert?
Yes. A medical case summary or a court ready chronology often tells you whether the case is worth an expert retainer. It also gives the expert an organized record instead of a raw production, which shortens the review and lowers the bill.
Do you provide experts for defense medical examinations?
We locate physicians for defense counsel who need an independent medical examination and a written report, and we locate experts for plaintiff counsel who need that report rebutted. The conflict check runs the same way in both directions.
What does a personal injury medical expert cost?
Rates are set by the individual expert and vary with specialty, record volume and whether testimony is required. We quote the specific expert before you commit, so there is no open ended engagement.
