Which expert does a nursing home case actually need

The most common reason a long term care opinion gets challenged is a discipline mismatch. A
physician is not automatically qualified to testify about nursing assessment, care planning or
facility staffing systems, and a floor nurse is rarely the right witness on medical causation. The

The regulatory framework the expert has to work inside

Federal participation requirements for Medicare and Medicaid certified facilities sit at
42 C.F.R. Part 483. Surveyors cite deficiencies by F-tag, and the tags that recur in litigation
include F684 quality of care, F686 skin integrity and pressure ulcers under 42 C.F.R. 483.25(b)(1),
F689 accidents, hazards and supervision under 42 C.F.R. 483.25(d), and F725 sufficient nursing
staff. A credible expert can tie the clinical record to the requirement that was not met, and can
also explain where a survey citation does not establish the civil standard of care. Both directions
matter, and the second one is where defense counsel usually needs the stronger witness.

Records to pull before the expert starts

  • Every MDS assessment and the care plans generated from them
  • Treatment administration and medication administration records
  • Wound assessment flow sheets and all wound photographs with dates
  • Nurse aide documentation, including turning, repositioning and intake records

  • Staffing schedules, assignment sheets and Payroll Based Journal data for the period
  • Policies and procedures in effect on the dates at issue, not the current version
  • Facility survey history, statements of deficiency and plans of correction
